Terms of Service

These Terms of Service (“Terms”) govern your use of the services provided by PUBORY LLC, operating under the brand name Pubory (“Pubory”, “we”, “us”, or “our”). By purchasing or using our services, you agree to be bound by these Terms. Please read them carefully.

1. Services

Pubory provides digital public relations, media outreach, link building, brand monitoring, and content amplification services as described on our website at pubory.com. The specific deliverables, timelines, and guarantees applicable to your engagement are set out in the plan you select at checkout or in a separate statement of work agreed between the parties.

We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice. We will not make material changes to your active plan without informing you at least 30 days in advance.

2. Payment Terms

Monthly Retainer Plans

Monthly retainer plans are billed in advance on a recurring monthly basis. Payment is due on the same date each month. We accept major credit cards and PayPal via Stripe. A professional invoice is issued for every payment. Failure to pay within 7 days of the due date may result in suspension of services.

One-Time Add-on Services

Add-on services are billed as one-time payments at the time of order. Delivery timelines are as stated on the service page. If we are unable to deliver within the stated timeline, you are entitled to a full refund per our Refund Policy.

3. Placement Guarantees

Each monthly retainer plan includes a contractual minimum number of media placements. If we fail to deliver the guaranteed number of placements in any given month, the deficit carries forward to the following month at no additional charge. If we consistently fail to deliver placements over two consecutive months, you may request a refund of the affected month's fees under our Refund Policy.

4. Refund Policy

Our full refund policy is available at pubory.com/refund-policy. In summary: we offer a 30-day money-back guarantee on the first month of any retainer plan if no placements are delivered within that period.

5. Client Obligations

You agree to:

• Provide accurate information about your brand, products, and services
• Respond to reasonable requests for materials, approvals, or feedback within 5 business days
• Not misrepresent your business to us or to any third parties in connection with our services
• Notify us promptly of any changes that may affect our outreach or strategy

6. Acceptable Use

You may not use our services to promote illegal activities, defamatory content, misleading claims, or any content that violates applicable laws or regulations. We reserve the right to terminate your account if we determine, in our sole discretion, that your brand or content violates these standards.

7. Intellectual Property

Content created by Pubory on your behalf (including press releases, pitch copy, and strategy documents) becomes your property upon full payment. Pubory retains the right to reference your brand as a client (e.g., in case studies or portfolio materials) unless you request otherwise in writing. All Pubory proprietary tools, methodologies, and systems remain our exclusive property.

8. Confidentiality

Both parties agree to keep confidential any non-public information shared in connection with the services. This obligation survives the termination of the agreement for a period of 2 years.

9. Cancellation

You may cancel your monthly retainer plan at any time with 30 days written notice to [email protected]. Services will continue through the end of the notice period. There are no cancellation fees.

10. Limitation of Liability

To the maximum extent permitted by law, Pubory's total liability to you for any claims arising from these Terms or our services shall not exceed the total fees paid by you in the 3 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages of any kind.

11. Warranties Disclaimer

Other than the placement guarantees expressly stated in your plan, our services are provided “as is.” We do not warrant that specific publications, journalists, or outcomes will result from our efforts beyond the guaranteed minimums. Media placement decisions are ultimately made by third-party editors and publishers.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Montana, United States of America. Any disputes shall be resolved first through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Missoula, Montana under the rules of the American Arbitration Association.

13. Changes to Terms

We may update these Terms periodically. We will notify you of material changes via email at least 14 days before they take effect. Continued use of our services after that date constitutes acceptance of the updated Terms.
